‘Smoking gun’ in ‘Happy Birthday’ copyright case

A New York film com­pany that is su­ing to have the rights to the song “Happy Birth­day to You” placed in the pub­lic do­main says it has un­covered a “smoking gun” in the form of a song­book pub­lished in the 1920s.
